We, the undersigned , being the Guarantor under the persent guarantce, hereby undertake, subject to no other conditions than those specified in this document and the above – mentioned Rutes, to pay to the above Beneficiary upon his request in writing or by cable, telegram or telex any sum or sums up to an aggregate maximum amount as stated above, provided.

1. That the claim for such payment is received by us as set out in Art. 8 of the Rutes not later than on the above expirty date.
2. That the claim incorporates a declaration of the Beneficiary that the  amount claimed has not otherwise been paid to him , whether directly or indirectly , by on behalf of the principal;
3. That the claim is supported by a declaration of Beneficiary That the Principal has failed to perform his obligations under the contract, specifying in what respect the principal has so failed, and That as a result there of the Beneficiary, under the termes of the said contract, has become entitled to payment of the amount claimed by him.
4. That the claim is supported by :

a)      a decision of a court of first instance;

b)      an arbitral award justifying the claim;

c)       the approval of the principal writing to the claim and the amount to be paid;

We as Guarantor will effect payment without any other delay than that necessary for us to satisfy ourselves that the conditions specified in the Rules and in this guarantec have been comptied with, and not later that (….) working days from the receipt by us of documentation as set out above.

Any dispute between ourselves a Guarantor and the Beneficiary relating to this guarantec or any payment there under shall be finally settled by arbitration under Rules of conciliation and Arbitration of the International Chamber of Commerce.
